The role you'll contribute:
This is an on-site position in the Denver Tech Center area. The Associate Chief Legal Officer for the Rocky Mountain Region works under the direction of and in cooperation with the Chief Legal Officer (CLO) to serve the in-house legal needs of the AdventHealth (AH) Rocky Mountain Region, which includes five hospitals and other related care sites and entities. Serves as legal counsel for the AH Rocky Mountain Region. Responsibilities include, but are not limited to: (1) advising medical groups in the AH Rocky Mountain Region regarding complex compensation arrangements, legal issues relating physician practice operations, e.g., billing, collections, coding, and reimbursement matters, and other regulatory matters pertaining to medical groups and employed physicians of AH; (2) advising various corporate departments on general legal matters; (3) drafting, negotiating, reviewing and approving for signature various provider-related agreements and relationships including those addressing employment, recruitment, termination, discipline, medical direction, professional and administrative services, joint ventures, practice acquisitions and other physician-related transactions; (4) advising the human resources staff; and (5) drafting, negotiating, reviewing and approving for signature various vendor agreements.
The value you'll bring to the team:
Assists CLO with the legal work for AdventHealth.
Provides counsel on transactional, regulatory matters, joint ventures, various models of physician alignment, complex compensation arrangements, compensation models, operational, billing, and coding compliance matters, and medical group governance structures.
Serves as a resource attorney for Legal Services for physician recruitment, physician employment, practice acquisitions, practice support agreements, practice affiliation agreements, professional service agreements, and other physician agreement.
Knowledge of health care law, including general principles of Medicare reimbursement programs, anti-fraud statutes and programs including the Medicare Fraud and Abuse (Anti-Kickback) Statute, Stark Rules, False Claims Act, and Civil Monetary Penalty Act.
Advises corporate departments, including human resources, information technology, managed care, nursing, risk management, corporate responsibility, business development, communications, and others.
Knowledge of federal and state tax law, real estate law, tort law, and contract law as those areas relate to health care law.
Provides the executive management team of the AdventHealth Rocky Mountain Region with an understanding of legal parameters and motivating compliance with legal requirements under the supervision and guidance of the CLO.
Adheres to the Rules of Professional Conduct of the Colorado Bar and other state bar associations of which he/she is a member.
Responsible for maintaining communication with other attorneys and/or senior leadership.
Reviews drafts, memoranda and/or other documents prepared by and for the CLO.
Identifies and attends at least one educational program to assist in gaining insight as to legal issues currently facing AdventHealth (as represented by current Legal Work).
Strong written and oral communication skills with the ability to interact well with people from various levels within the organization.
Ability to work effectively with others as well as work independently, without close supervision.
Strong analytical abilities and abilities to work effectively under strict time constraints.
Qualifications
The expertise and experiences you’ll need to succeed:
Required:
Member of the Colorado Bar.
Graduate from an accredited law school.
Minimum 10 years health law experience.
Preferred:
Board certified in health law or board eligible.
Experience with medical groups and/or physician practice management.
Specific experience in regulatory compliance in the areas of fraud and abuse, anti-referral laws, federal privacy laws, and research involving human subjects.
Experience in acquisition of medical practices.
Experience with academic affiliations
Experience advising corporate departments, including human resources, information technology, managed care, nursing, risk management, corporate responsibility, business development, communications, and others.
Teaching ability. Ability to lead a diverse work group or team effectively and efficiently to completion of associated goals.
